Man Awarded €128,000 After Neighbor’s Firearm Injury
In a landmark ruling, a Donegal man has been awarded €128,000 after sustaining severe injuries when a neighbor discharged a firearm during a dispute over a right of way.
Firearm Incident in 2015
In 2015, Patrick J Friel, then 59, of Churchill, Letterkenny, Co Donegal, was involved in a heated argument with his neighbor regarding a right of way. In the heat of the moment, the neighbor, acting irresponsibly, discharged a firearm, striking Friel in the face with 14 pellets.
“I was left with 14 pellets embedded in my face, requiring surgery. It’s been a long, painful journey since then.”

Legal Battle and Settlement
Friel subsequently brought a case against his neighbor, seeking damages for the injuries sustained. The High Court, in a recent judgment, ruled in Friel’s favor, awarding him €128,000 in damages.
Friel’s neighbor had previously pleaded guilty in the Circuit Court to possession of a firearm without a certificate and assault causing harm. The Probation of Offenders Act 1907 was applied.
Impact on Firearm Laws and Safety
This case underscores the importance of responsible gun ownership and the severe consequences of careless and reckless behavior. It serves as a reminder to all gun owners to prioritize safety and always adhere to the law.

In Ireland, it’s illegal to possess a firearm without a valid certificate, and anyone found guilty of assault causing harm can face severe penalties, including imprisonment.
Looking Ahead
Friel, now 64, hopes that his experience will serve as a cautionary tale for others. “I never want anyone else to go through what I’ve been through,” he said. “Guns should be handled with the utmost care and respect for the law.”
