Travel Rights Amidst Middle East Crisis: Cancellations, Disruptions & What You Need to Realize
Published: March 4, 2026
Understanding Your Rights as a Traveler
Travelers facing potential cancellations or disruptions due to the ongoing situation in the Middle East are seeking clarity on their rights. The European Consumer Center Austria, in association with the Association for Consumer Information (VKI), is providing guidance to facilitate navigate these complex situations.
If You Are Already in the Crisis Region
- Safety First: Register with the Austrian Foreign Ministry’s travel registration, contact the embassy or consulate and follow local authorities’ instructions. The Foreign Ministry’s emergency number is +43 1 90115 4411.
- Check Departure: Immediately contact your tour operator or airline. Rapid action is critical when airspace is affected.
Flight Cancellations: What Entitlements Do You Have?
If your flight is canceled even as traveling with an EU airline from a third country to the EU, you are entitled to free rebooking or a full ticket refund, as well as support services like meals and hotel accommodations. However, acts of war are considered “extraordinary circumstances,”
meaning additional compensation payments are not typically guaranteed.
Package Tours: Your Protections
For package tours, if there is a significant impairment
to your trip, the organizer must arrange free return transport. If immediate return isn’t possible, they must cover accommodation costs for up to three nights (with exceptions for particularly vulnerable individuals). They also have a legal obligation to provide assistance.
It’s important to note that the EU air passenger rights offer better protection than the package travel law.
If a flight is delayed by more than three days, the airline must provide and cover overnight accommodation until then, whereas a tour operator would only cover up to three days.
Imminent Trip: Can You Cancel for Free?
A free cancellation isn’t automatically granted with an official travel warning alone. The Austrian Supreme Court (OGH) has clarified that the key factor is whether the danger at your destination significantly exceeds the general risk to life
and whether the trip is unreasonable for an “average traveler”
– even if flights are still operating.
Package Tours: Stronger Cancellation Prospects
Travelers can cancel package tours without fees if unavoidable and extraordinary circumstances
occur at the destination or nearby that significantly impact the trip, provided there’s a temporal connection (e.g., departure within a few days). A full refund of the travel price is due, but no additional compensation is available.
Individual Travel: A More Complex Landscape
If you’ve booked flights, accommodation, rental cars, and excursions separately, the situation is more complex due to multiple contracts. Contracts can be voidable if fulfillment becomes meaningless due to unforeseen external events like war (loss of the basis for the transaction
). For EU flights facing airspace closures, you’re entitled to alternative transport or reimbursement. However, there’s no uniform legal basis for accommodation and rental cars as with package travel; individual national laws apply. Always check the providers’ cancellation and rebooking conditions. Enforcing claims is more challenging and depends on the specific case.
Trip in Several Weeks: Postpone or Wait?
The possibility of a later free withdrawal depends on whether the risk situation has unforeseeably worsened
after the contract was signed. If you book knowing about the crisis and the situation doesn’t significantly deteriorate, you generally won’t be able to claim unreasonableness. Cancellation fees may then apply, potentially reaching 100% close to the departure date.
- Cost-Risk Assessment: Cancellation is always possible, but it may incur a fee. Waiting carries the risk of increasing cancellation costs, but a significant worsening of the situation before departure could support a free cancellation claim.
- Recommendation: If traveling in several weeks or months, avoid premature cancellation. The security situation is continually reassessed, and waiting to see how things develop is often advisable.
