The State Judicial Agency (AJE) held, on Friday December 27, 2024, in Ouagadougou, a discussion meeting with the directors of judicial affairs and litigation from ministries and institutions.
The State Judicial Agency (AJE) is developing initiatives with the aim of ensuring better management of disputes involving the State and its branches. With this in mind, the institution held, on Friday December 27, 2024, in the capital, a discussion meeting with the directors of judicial affairs and litigation from ministries and institutions.
The meeting was held on the theme: “Collaboration between the State Judicial Agent and the legal affairs and litigation departments of ministries and institutions: what mechanism for better monitoring of cases involving the State and its branches ? “. According to the State’s judicial agent, Karfa Gnanou, this meeting made it possible to discuss the role, missions and place of the correspondent in the State’s advice and representation system, to reflect on the perspectives of formalization and
to institutionalize consultation between the AJE and its correspondents and to carry out a review of the directory of correspondents.
This meeting, added Mr. Gnanou, was an opportunity to recall the general framework for prevention and management of State litigation and to present an application for monitoring cases involving the State and its branches. Karfa Gnanou, on the occasion, confided that the AJE receives annually for processing 50 mandatory preliminary administrative appeals, 100 requests for legal opinions and nearly 1000 new cases brought before the courts. He also noted that thanks to the synergy of action between its structure and the legal affairs and litigation departments of ministries and institutions, beneficial results have been achieved.
In this regard, he cited, among other things, nearly 80% of cases won, 3 billion CFA francs in recovery for the benefit of the State and its branches, 5 billion CFA francs in condemnation for the benefit of the State and its dismemberments and 30 billion CFA francs in sentences avoided. For Mr. Gnanou, the point of the meeting is to improve these results. To do this, the legal affairs and litigation departments of ministries and institutions have a part to play.
“To the extent that litigation arises before we can take charge of it, we want these directors to contribute to preventing the emergence of litigation through their involvement in taking administrative acts that affect those administered. If litigation arises, our wish is that they collaborate with the AJE to provide us with as much information as possible for better handling of the cases,” he explained.
