Chilean Football Undergoes Landmark Reform: New Rules for Oversight and Transparency

Chilean football is poised for significant change following the approval of reforms to the law governing Professional Sports Public Limited Companies (SADP). The changes, approved by a vast majority in the Chamber of Deputies, aim to introduce structural changes to Chilean football in areas of governance, oversight, and transparency.

Key Changes Approved

The approved project received 148 votes in favor and one abstention and now awaits publication in the Official Gazette to seize effect. The session included participation from Minister of Sports, Natalia Duco, Undersecretary Andrés Otero, and Senator Matías Walker, a key proponent of the initiative.

Separation of ANFP and Chilean Football Federation

A central component of the reform is the separation between the ANFP and the Chilean Football Federation. This redesign will focus the federation on national teams and training football, while the ANFP will assume responsibility for organizing the professional league.

Restrictions on Club Ownership

The reforms also establish the end of timeshare in Chilean football, prohibiting any individual or entity from holding participation in more than one club. The presence of agents or representatives of players in ownership or management positions is now prohibited.

Enhanced Oversight and Financial Reporting

New inspection requirements are being implemented, with oversight responsibilities shared between the Ministry of Justice and the National Sports Institute (IND). Clubs will also be required to submit semiannual financial reports.

Increased Transparency and Accountability

SADPs will be required to report suspicious operations to the Financial Analysis Unit (UAF) and are obligated to identify your final beneficiaries to ensure greater traceability in club ownership.

Fan Participation and Incompatibilities

The legislation establishes incompatibilities between management positions and introduces mechanisms to promote participation of fans and partners in the management of sports institutions.

The reform modifies a law that has been in force since 2005, which initially allowed the transformation of clubs into public limited companies.

Institutions will have 18 months to adapt its statutes following enactment, ushering in a new stage in Chilean football characterized by higher standards of control, transparency and regulation.
